Kyle Payne sentencing update

For those of you who have been following the Kyle Payne legal situation, here’s some info I received from the reporter covering the case, with her permission:

Hi. I’m Lynda Waddington, the journalist who wrote the recent post about Kyle Payne accepting a plea agreement on Iowa Independent (as well as on my personal site, Essential Estrogen).

Some individuals who have commented to the various postings on Payne have stated that he is scheduled to have an “open sentencing” on Aug. 11 at the Buena Vista County Courthouse, and that anyone who attends will have an opportunity to speak. This is not totally correct.

An “open sentencing” in the state of Iowa means that the public can attend, but not that the public can speak. While it always looks good to have people show up in support of the prosecution — and I’d personally really like to see some strong support in the courtroom — the fact is that not everyone is going to be able to speak.

For those who have a unique interest in the case… for instance, have served as advocates or can somehow speak with authority as to how horrible Payne’s actions were… get in touch with me.

If you want to share your (civil) thoughts about this incident prior to sentencing, your best bet is to write to the judge that will preside over the sentencing:

As a final note, there has been some discussion about Payne being charged with child pornography. This is not a charge he faces from the state of Iowa.

  • Thanks for the update – I’m considering sending a (polite, of course) letter to the judge, but considering I don’t really live in Iowa, maybe it wouldn’t amount to much? I guess it couldn’t hurt.

I hate this kid and want to ruin his life, (as he has scarred his vicitims) but he made it easy by doing it himself. Thanks Eleanor for putting this out there.     I am curious was a pleabargin was reached. I have place a call into the Buena Vista County, Iowa Attorney who is suppose to be the Chief Law Enforcement official in Buena Vista County, Iowa. Asking why a reduced charge was agreed to. From the little bit I have read on this and the post on Paynes website asking for forgiveness. I wonder if the attorney has a daughter?/ I believe Payne should have faced the maximum charge as well as the maximum punishment

    I have written the Judge as well as the County Attorney a letter that I have asked to be read at Kyle Paynes sentencing.

    The BV County Attorney says only 2 emails have come to him about Kyle Payne and we were told today it looks like NO JAIL TIME could happen. PLEASE help my niece….. Fax your letters to the county attorney and here is the fax and case number for the judge.

    The judge can turn down a deferred sentence recommendation if he so chooses. Help to stop my niece’s offender so that other women are not a victim of Kyle Payne.

  • Kyle Payne was sentenced to 6 months in the county jail and years of probation. At least he didn’t walk.

    Neither his sentence nor the reduced offense reached in the plea agreement require him to register as a sex offender. With his deferred sentence, the crime will be wiped from his criminal record in 3-4 years, leaving another victim/community a chance to find out who he really is…the hard way.

    He can be ordered by the county to register as a sex offender, which would put the ball in his court in fighting that order. The state would support that, and ultimately a judge would make the final decision.

    There needs to be a petition to make this happen, as I don’t think it will on its own given the limp-arm’d approach of the county attorney. If we can get him on the state registry, he’ll be obliged to register at the federal level as well. Once required, both are for life.
